Intellectual Property Errors
Intellectual Property (IP) Errors are less frequent than brand image errors, but they can carry significant financial and legal consequences. Mistakes such as missing trademark symbols, unlicensed use of images or fonts, or the unauthorized use of personal names can lead to costly infringement claims, legal disputes, or loss of exclusive rights. These errors not only risk expensive lawsuits and settlements but also jeopardize a brand’s proprietary assets. The cost to repair IP errors is high, especially if rebranding or product redesign is necessary. In cases of infringement, defending against legal challenges can be resource-intensive and damage the brand’s reputation, making proactive IP protection critical.
Error Types:
Missing Trademark Symbols (™ or ®): Failure to display the ™ or ® symbol on a trademarked brand name, logo, or slogan, which may weaken legal protection.
Unlicensed Use of Fonts, Images, or Graphics: Use of proprietary fonts, stock images, or designs without obtaining proper licenses or permissions.
Unauthorized Use of Personal Names or Likenesses: Featuring an individual’s name, likeness, or personal brand on a label without formal consent or license.
Inconsistent Trademark Usage: Using variations of a trademark or failing to use it in the correct format, which can affect legal protection.
